Can an employer terminate an employee without notice?

A

It depends on the employment contract, standing orders and applicable legislation. For establishments covered under the Industrial Disputes Act, termination of "workmen" (non-managerial staff) requires notice, retrenchment compensation and government permission in certain cases.

What is the POSH Act?

A

The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 requires every employer with 10 or more employees to constitute an Internal Complaints Committee (ICC) and have a written anti-sexual harassment policy. Non-compliance attracts penalties.

What PF and ESI deductions are mandatory?

A

Establishments with 20 or more employees must register with EPFO (EPF deduction: 12% of basic by both employer and employee) and ESIC (ESI: 3.25% employer, 0.75% employee on gross wages up to ₹21,000/month). We advise on thresholds, exemptions and compliance.

What are the new Labour Codes?

A

India has consolidated 44 central labour laws into 4 Labour Codes: the Code on Wages, Code on Industrial Relations, Code on Social Security and Code on Occupational Safety. We advise businesses on transitioning to the new Codes as they are notified state by state.
